§ 91.06 CURBING AND GUTTERING REQUIRED.
   (A)   No person shall build within the city any dwelling house or other building on a lot fronting a city street or road, where there is not then existing curbing and guttering, without also constructing curbing and guttering along the street or road frontage. The curbing and guttering shall be of like or similar design and quality as curbing and guttering then being installed by the city or of a quality and design otherwise approved by the City Council.
   (B)   In the event that curbing or guttering would be impractical or otherwise undesirable, any person may petition the City Council for a variance or exemption from this section. The City Council shall grant the variance or exemption only upon a showing by the petitioner that it would be in the best interest of the city to grant the variance or exemption. The City Council shall not grant a variance merely on the basis that it would be an inconvenience for the petitioner to construct or have constructed the curbing and guttering.
