EXCAVATIONS AND CONSTRUCTION
§ 91.01 OPENING PERMIT REQUIRED.
   (A)   No person or corporation shall enter upon any street, road, or alley in the city for the purpose of laying conduits, pipes, poles, wires, or sewers, therein or thereunder, or make any obstruction thereon, or any excavation thereunder which necessitates any change in the condition or structure thereof without first obtaining a permit from the city as herein provided, and giving a performance bond to the city as herein provided for the performance of the requirements herein provided.
   (B)   Any person or corporation making any opening or excavation as herein provided shall remove and carry away all dirt from the street, alley, or road as herein provided.

§ 91.02 APPLICATION FOR PERMIT.
   Any person or corporation desiring a permit, as provided in § 91.01 above, shall file with the Building Committee a written and signed application, accurately describing the nature of the work contemplated, the particular location, the time work will commence, and the probable duration thereof. The Building Committee may require any application to be amended or made more definite and certain, or may direct the filing of a new application. Upon the filing of a proper application, the Building Committee may grant a permit in whole or in part, as applied for, and may impose such reasonable conditions and terms as may be deemed proper, or the City Council may refuse to grant the permit. No permit shall be issued unless application therefor has been approved by all three members of the Building Committee, and the permit must be signed at City Hall by all three Committee members.

§ 91.03 PERFORMANCE BOND.
   All applicants for a permit, as provided in § 91.01, shall before a permit is granted be required to post a bond with the City Clerk-Treasurer/Tax Collector in the amount of $100 for any opening into a street up to 25 square feet; and $100 for each additional 50 square feet or any part thereof, for the performance of the conditions and requirements herein set out or as may be reasonably required by the City Council. The bond above required will be returned to the applicant within 30 days after inspection and acceptance by the city. However, for any work not satisfactorily done and which has to be replaced by the city, that portion of the bond shall be forfeited.

§ 91.04 RESTORATION OF PAVEMENT; INSPECTIONS; SPECIFICATIONS.
   (A)   The City Supervisor shall be notified when each opening is to be backfilled and before the backfill is commenced shall make inspection of any connection to the sewer system and may require any defects found to be replaced before the backfill is made. After the backfill has been completed the City Supervisor shall be notified and at which time he will make a final inspection.
   (B)   Each opening in the street, road, or alley, shall be backfilled with the following: pit run, sand, or lime to within six inches of paved surface; the next four inches to be covered with #610 crushed linestone; the limestone to be covered with two inches of compacted blacktop or the equivalent thereof.

§ 91.05 BARRIERS AND WARNING FLARES AROUND EXCAVATIONS.
   Any person or corporation making any opening or excavation into a street, road, or alley, as herein provided, shall place good and sufficient markers near the excavation so as to warn the traveling public of the nature and extent of the obstruction of the street, road, or alley; and the person or corporation shall cause a sufficient number of flares to burn from one hour before dark until one hour after daylight so as to warn the traveling public of the danger ahead.
