§ 50.09 SERVICE TAPS; EXTENSIONS.
   (A)   Tapping of any water or sewer main for the purpose of making connection shall be done only by authorized personnel of the city during regular business hours. Distribution or collection mains shall be provided, at the discretion of the City Council, in streets, avenues, or alleys abutting the property to be served. Water facilities for hookups shall be provided, unless otherwise specified by the City Council, to the curb line from the distribution or collection main. Extension of distribution or collection mains shall be only as specified by the Council in its discretion.
   (B)   Any property owner may petition for a new hookup or connection to any city utility service line. The City Council, in its discretion, may allow such connection or hookup. The City Council may refuse any such petition if:
      (1)   In the judgment of the City Utility Foreperson that the city utility service line(s) to the location set forth in the petition may not adequately serve such additional customer(s);
      (2)   The petitioner has, within the preceding 12-month period, a history of unpaid or delinquent utility bills to the city;
      (3)   If such petition is for an additional hookup or connection to a property currently being served by city utilities and in the judgment of the City Utility Foreperson that such existing city utilities will adequately serve the needs, as set forth in the petition, of the petitioner; or
      (4)   Any other issue, as determined by the City Utility Foreperson, that would make such new hookup or connection unnecessary or detrimental to the city utilities.
   (C)   The petitioning property owner shall pay the cost for said hookup or connection from the point it joins the city distribution point at the nearest main service line. The petitioning property owner must pay the estimated cost of said hookup or connection prior to such hookup or connection. In the event that the actual cost of said hookup or connection is greater than the estimated payment made by the petitioning property owner, then the petitioning property owner must pay the remaining difference within 15 days of the completion of said hookup or connection.
   (D)   In the event that the nearest main service line is more than 150 feet from the customer’s buildings to be served by city water service, the city shall place such pit and curb stop adjacent to the nearest main service line. If necessary, the customer shall petition all appropriate government agencies and/or adjoining property owners for the purpose of obtaining any required variance, rezoning, easement, or other permits for the placement of such pit and curb stop.
