(a) No person, firm or corporation owning, driving or operating a vehicle collecting, hauling and/or disposing solid waste shall collect, transport or transfer solid waste or cause the collection, transportation or transfer of solid waste other than between the hours of 7:00 a.m. and 7:00 p.m. or on Saturdays after 4:00 p.m. or on Sundays.
(b) An application for an exception to any of the provisions of subsection (a) hereof may be made by any person, firm or corporation to the Director of Public Service and Development on a form provided by the Director and the payment of an application fee of twenty-five dollars ($25.00). The Director may grant an exception to any of the provisions of subsection (a) hereof only where the applicant for an exception is able to demonstrate to the Director great practical difficulty in the collection, transportation or transfer of solid waste from a specific premises between the hours or during the days set forth in subsection (a) hereof due to vehicular and pedestrian traffic and the concentration of commercial or business activity.
(c) Whoever violates this section is guilty of a misdemeanor of the fourth degree for a first offense and a misdemeanor of the third degree for each subsequent offense.
