The following conditions are public nuisances whenever they may be found within the town:
(A) Any living or standing elm tree or part thereof infected to any degree with the Dutch Elm disease fungus, Ceratocystis ulmi, and which harbors any of the elm bark beetles, Scolytus multistriatus or Hylurgpoinus rufipes; and
(B) All limbs or trees, shrubs, bushes and plants which project over any public sidewalks, streets or alleys and which are less than eight feet above the surface of said public sidewalks, and less than 14 feet above the surface of any such street or alley.
