(A) Whenever the Chief of Police or his or her agents have reason to believe that uncontrolled plant growth is present upon property within the town in violation of this subchapter, he or she shall forthwith inspect the premises, and if such growth is found, he or she shall cause written notice to be served upon the owner of the property on which such growth exists, directing the owner to comply with the provisions of this subchapter by removing said conditions within ten days after service of notice. Such notice shall advise the owner of what steps are required to come into compliance with the provisions of this subchapter. The owner shall be determined from the last completed assessment roll of the County Assessor.
(B) The Town Clerk shall give notice to destroy weeds within the town limits by publishing notice to the public at least once each week for two consecutive weeks. The last publication shall be not less than seven days prior to May 15. Such notice shall advise the public as follows.
(1) All owners of real property or agents having control thereof are responsible for destroying, removing or cutting all weeds not later than May 15 of each year and to keep such property free of weeds through November 30 of each year.
(2) Failure to remove weeds may cause the town to remove the weeds and charge the cost thereof against the real property together with a penalty of $500 for each time to town provides removal.
