§ 90.03 RUNNING AT LARGE; IMPOUNDMENT.
   (A)   It shall be unlawful for any person to permit his or her stock, horses, cattle, sheep, swine or other animals to run at large upon the streets, alleys or public places within the town limits, excepting as may be necessary when driving such animals into or through the town.

   (B)   It is hereby made the duty of the Chief of Police or any resident of the town finding such animals so running at large to take them up and hold them until the owner or some other person shall pay the sums and costs accruing by reason of taking up and keeping of such animals. Any person taking up and impounding such animals may charge, for the first offense, the sum of $50 per head for impounding and $10 per head per day for each succeeding day of keeping same; and for the second or succeeding offenses may charge the sum of $100 per head for impounding and $10 per head per day for each succeeding day of keeping same.

   (C)   (1)   If such animals so taken up shall not be redeemed by the owner or some person interested therein, by paying such costs and such damages within three days from the taking up of the same, the Chief of Police shall sell such animals, after giving public notice thereof by one publication in the town’s newspaper at least five days prior to the sale, to the highest bidder, and out of the proceeds shall pay all costs pertaining to the taking and keeping of such animals; and all surplus of such sale after the above-said expenses are paid shall revert to said owner.
      (2)   If said owner is not found within six months from time of sale, such surplus shall be turned over to the Town Treasurer.
