351.15 PARKING ON TREE LAWN AREAS.
   (a)   Tree lawn areas may only be used for parking purposes provided:
      (1)   That all such tree lawn areas intended for parking purposes have been surfaced with concrete, asphaltic macadam or other suitable hard surfacing material.
      (2)   That the parking areas are curbed so that parked vehicles do not in any way interfere with or encroach upon the sidewalk or area intended for pedestrian use, adjacent to such parking area.
   (b)   No such parking area shall be constructed without prior authorization by Council and written permission of the Mayor.
   (c)   For all intents and purposes, the tree lawn area shall constitute that area between the curb, edge or lateral lines of the road, street or highway and the sidewalk or area intended for pedestrian use.
   (d)   Parking of motor vehicles within the described areas on a private road or driveway are expressly prohibited.
   (e)   This section is subject to parking restrictions contained in Section 351.17.

   (f)   Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
