509.08 MINOR’S CURFEW.
   (a)   Hours of Curfew. Between the hours of darkness to dawn, no child under the age of twelve years, and the between the hours of 11:00 p.m. and 6:00 a.m. local time, no child between the ages of twelve and sixteen years, and between the hours of 12:00 midnight and 6:00 a.m. local time, no child between the ages of sixteen and eighteen years shall be upon any streets, roads, sidewalks, parks, beaches, parking lots, public or private playgrounds, public or private school grounds, church grounds or recreation areas unless accompanied by a parent, guardian or some responsible person over twenty-one years of age, or a member of such child’s family over eighteen years of age.
   (b)   Parent or Guardian. No parent or guardian shall allow any child between the ages and the hours applicable to such child as set forth in subsection (a) hereof to be upon any streets, roads, playgrounds, public or private school grounds, church grounds or recreation area.
   (c)   Curfew Not Applicable. This curfew shall not apply to minors on an emergency errand or as directed by the parent, guardian, custodian, or some responsible person over the age of twenty-one years, or a member of such child’s family over eighteen years of age who has been given legal responsibility for such minor’s control and custody. Furthermore, this curfew shall not apply to minors returning from any school, church, lodge or other legitimate organization sponsoring functions wherein such minors were in attendance. However, if such minors are not within the confines of their respective home sites one hour after such function is ended, the provisions of this curfew shall be applicable and in full force and effect. Furthermore, this curfew shall not apply to minors who are returning from lawful employment.
   (d)   Violations. Whoever violates subsection (a) or (b) hereof is guilty of a curfew violation, a misdemeanor of the fourth degree.
