§ 154.200 ADULT BUSINESS PERMIT REQUIRED; APPLICATION.
   (A)   No adult business shall be established until an application for an adult business permit is approved by the Planning Board pursuant to the procedures set forth in this chapter.
   (B)   An application for an adult business permit shall contain the following information; A written site plan, outlining the following shall be submitted with conditional use permit application:
      (1)   Owner of the parcel, including address and phone contact;
      (2)   Lessee: all parties to the lease;
      (3)   Length of lease;
      (4)   Hours of operation;
      (5)   Number of employees;
      (6)   Floor plan depicting location of proposed uses within the structure;
      (7)   Maximum number of people that will be occupying the structure at 1 time; and
      (8)   A statement listing mechanism(s) that will be used to detect fire arms.
   (C)   When an adult business permit application is filed, it shall be accompanied by a filing fee in the amount of $250.
   (D)   When an application has been accepted as complete, the Planning Director shall set the application for a public hearing before the Board of Commissioners within 60 days from the date on which the application was accepted as complete. The Planning Board shall approve or disapprove the application within 90 days from the date on which the application was accepted as complete by the Planning Director.
   (E)   In considering an application for a permit pursuant to this chapter, the Planning Board shall approve the permit if it makes the following findings:
      (1)   The adult business is consistent with the location and development standards contained in this chapter;
      (2)   The adult business is located in a zone classification which lists the adult business as a permitted use; and
      (3)   Except as specifically provided in this chapter, the adult business complies with the development requirements prescribed in this chapter.
   (F)   Issuance or denial of the permits is subject to administrative appeal as set forth in this chapter.
