(A) Initiation of conditional use. Any person having freehold interest in land, or a possessory interest entitled to exclusive possession, or a contractual interest which may become a freehold interest or an exclusive possessory interest, and which is specifically enforceable, may file an application to use the land for 1 or more of the conditional uses provided for in this chapter in the zoning district in which the land is located.
(B) Application for special use permits. Applications for the special use permits, signed by the applicant, shall be addressed to the Town Board and presented to the Zoning Enforcement Officer. Each application shall contain or be accompanied by legal descriptions, maps, plans and other information so as to completely describe the proposed use and existing conditions. The application shall be forwarded to the Town Board and the Zoning Enforcement Officer shall notify the Chairperson of the Planning Board of the application.
(C) Fee. The Town Board shall set a fee, to cover the necessary administrative costs and advertising of each application for a special use permit. The set fee shall be posted in the Town Clerk’s office.
