§ 94.23  ANIMALS AT LARGE.
   (A)   It shall be unlawful for any owner or person having care, responsibility, or custody of any horse, mule, cow, goat, sheep, hog, dog, cat, chicken, duck, goose, or any other animal to allow the animal to run at large in the corporate limits of the town. Every animal found running at large within the corporate limits of the town shall be taken by the Department of Public Works or law enforcement, confined, and shall be impounded pursuant to § 94.33.
   (B)   Any person who violates division (A) shall be liable for damages in a private lawsuit for any damages caused to any person whose property is damaged while the animal is at large and shall be subject to the enhanced penalties of § 94.99(B)(2).
   (C)   It shall be unlawful for any owner or person having care, responsibility, or custody of any to allow or permit the animal to discharge feces or urine upon the premises of any other person. However, if that person shall remove the feces deposited by the animal within 5 minutes of its deposit, or if the owner of the property has given permission allowing use of the property for discharge feces or urine, then such activity shall not be a violation of this section.
