(a) The City of Fairmont is authorized and empowered to enforce this Article of the City of Fairmont, in Addition to prosecution under terms of the City Code, by applying for injunctive relief in the Circuit Court of Marion County, West Virginia and shall be authorized to institute any other appropriate proceeding or action in any other court of competent jurisdiction.
(b) Violation of any provision of this article of the City of Fairmont shall be a misdemeanor, punishment by a fine of $50.00 for each separate offense. Each separate day a violation occurs shall be considered a separate offense. Provided however, that the total aggregate of all fines and costs shall not exceed $500.00 or 10% of the total cost of the work performed without a certificate of appropriateness, whichever is greater.
