175.04 MEMBERS; COMPENSATION.
   The Human Rights Commission shall be composed of seven members to be appointed by the City Manager and confirmed by the Council. All members appointed to serve on the Commission shall be residents of the City of Fairmont.
   No member may hold office in any political party.
   Members of the Commission shall be appointed for terms of three years commencing on the effective date of this Ordinance; provided, however, that subsequent to the initial appointment or in the event of a vacancy prior to the expiration of the initial term or in the event of re-appointment following the initial term; the terms of such Commissioners shall be as follows: three members of the Commission or their replacements shall be appointed to a three year term or remaining portion thereof to expire on November 15, 2023; and four members of the Commission or their replacements shall complete their original term of appointment or their replacements shall be appointed for the remaining portion thereof which term shall expire on November 15, 2021. All subsequent appointments for a full three-year term shall be from the date of expiration of the then expiring term. Except as hereinbefore provided, appointments to fill vacancies shall be for the unexpired term thereof. Members shall be eligible for reappointment for two successive terms. In no event shall a member of the commission serve more than three consecutive terms. Before assuming and performing any duties as a member of the Commission, each Commission member shall take and subscribe to the official oath prescribed in Section 5, Article IV of the Constitution of West Virginia, which executed oath shall be filed in the office of the Clerk of the City.
   Members shall serve without salary, provided, however, members shall be reimbursed for any reasonable and necessary expenses incurred in performance of the Commission services.
   Any member shall forfeit his office if such member fails to attend three consecutive regular meetings of the Commission without being excused by the Commission as reflected in the minutes. Vacancies may be filled by appointment by the City Manager and confirmed by Council for the unexpired term.
