131.10 SPECIAL POLICE FOR PARKING AREAS.
   (a)   Establishment of Position. There is hereby established the position of parking enforcement officer who shall be appointed by the City Manager, and whose sole duties are to patrol and to enforce municipal parking ordinances upon or within designated municipal parking areas and upon municipal streets. Parking enforcement officers may sign complaints and issue citations. Nothing herein shall be construed as providing for appointment, promotion or demotion pursuant to the Civil Service Act for Certain Police Departments, West Virginia Code §8-14-6 et seq., or to provide any benefit under the Policemen’s Pension and Relief Fund provisions of West Virginia Code §8-22-1 et seq.
   (b)   Powers in Respect to Parking Ordinances. Parking Enforcement Officers shall patrol and enforce all Municipal parking ordinances, which may be in effect from time to time, upon or within designated parking lots, parking buildings, parking garages and parking facilities, either owned by or leased to, or under the control of, and operated by, the City or any board, commission or authority created by the City and upon all municipal streets. In the performance of such duties parking enforcement officers shall be vested with the power to issue citations, summonses or tickets, sign complaints and request the issuance capiases and all such other powers as may be necessary and incidental thereto. Such parking enforcement officers shall (1) be in uniform (2) display a badge or other sign of authority; and (3) serve at the will and pleasure of their employer.
   (c)   Additional Powers in Respect to Curbline Parking. Parking enforcement officers shall have the authority to issue overtime parking notices or tickets to all motorists who permit any vehicle or any vehicle permitted to remain or be placed in any parking space adjacent to any parking meter while such meter is displaying a signal indicating that the vehicle occupying such parking meter space has been parked beyond the period of time established in that parking meter zone.
   (d)    Definitions.
      (1)    "Ticket" means an order or summons by which one is directed or notified to appear at a time and place named.
      (2)    "Notices" means a written communication, the result of observation, of the existence of a fact or state or affairs, to wit, of overtime parking.
