(a) Non-refundable filing fees are those established and required by Section 8.11 Fees of the City of Fairmont Planning and Zoning Code.
(b) The filing fees established by Section 8.11 Fees of the City of Fairmont Planning and Zoning Code shall be in addition to any other requirement which may be provided elsewhere in this code.
(c) In addition to the filing fees established by Section 8.11 Fees of the City of Fairmont Planning and Zoning Code, the applicant shall be responsible for the actual costs of providing the required legal notice. At the time of filing, the Planning Office shall estimate the cost of providing legal notice, and the applicant shall deposit with the Planning Office the amount of the estimate. If the cost actual of providing legal notice exceeds the amount of the estimate, the applicant shall be responsible for and pay the difference between the estimate and the actual cost; provided, however, that if the estimate exceeds the actual cost, the applicant shall be entitled to a refund of the amount that the deposit exceeds the actual cost.
