1769.01 DEFINITIONS; PURPOSE.
   (a)    Definitions: The following words, terms and phrases, when used in this Article, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:
      (1)   Vacant building shall mean any building, improvement or other structure, whether residential, commercial, or mixed, that is, has been or becomes for a period of 180 days either: 1) unoccupied; or 2) unsecured and occupied by one or more unauthorized persons; provided however, that a new building under construction shall not be deemed a vacant building; provided further that the governing body shall, on a case by case basis, upon request by the owner exempt a vacant building from registration for good cause show that the owner will be unable to occupy the building for a determinant period of time,
   (b)    Purpose: The purpose hereof is to ensure that all vacant buildings are secure, weather- tight, safe for entry by police officers and firefighters in an emergency, and to further ensure that all such structures do not present or become a future hazard to the public, injurious and inimical to the public health, safety and morals of the City and her citizens during the time that the structure remains a vacant building.
