113.04 PREFERENCE FOR RESIDENT VENDORS.
   (a)   Other provisions of this article notwithstanding, in any instance in which a purchase of supplies, materials and equipment by the City of Fairmont is required under the provisions of this article to be made upon competitive acquisition and such purchase is upon competitive sealed bid, then such purchase shall be made from a resident vendor, provided such bid does not exceed the lowest qualified bid from a nonresident vendor by more than five percent (5%).
   (b)   A vendor shall be deemed to be a resident of the City if such vendor is an individual partnership, association or corporation that maintains an active bona-fide place of business within the City, is licensed to do business by the City and pays the privilege tax imposed by the City business and occupation tax.
