113.03 DISPOSAL OF SURPLUS AND OBSOLETE PROPERTY.
   (a)   Personal Property: All materials, supplies and equipment deemed by the City Manager to be surplus or obsolete shall be disposed of at his direction by the Administrative Assistant of Purchasing in accordance with the provisions of West Virginia Code §8-12-18. The City Manager shall promulgate written rules and guidelines which set forth the manner and methods by which the City shall dispose of any item of material, supply or equipment which a value of less than one thousand dollars ($1,000.00) and the manner and method by which the City shall trade equipment, supplies and materials for new or other equipment, supplies and material.
   (b)   Real Property: The City is hereby authorized and empowered to sell any of its real property or any interest therein or any part thereof in accordance with the provisions of West Virginia Code 8-12-18; provided however that the requirements of notice and public auction shall not apply to the sale of any one parcel of real property of the City of less value than fifteen thousand dollars ($15,000). The City Manager shall promulgate written rules and guidelines which set forth the manner and methods by which the City shall sell any one (1) such parcel of real estate. Nothing herein shall be construed to circumvent the requirements of West Virginia Code §8-11-3(6) and §2.12(6) of the City Charter, which require that any sale or conveyance of City owned real estate must be authorized by Council by ordinance.
   (c)   Severability: If any section, subsection, sentence, clause or phrase of this section shall be declared invalid or shall be rendered inoperable for any reason whatsoever, such invalidity or inoperability shall not affect the remaining portions of this section which shall continue in full force and effect, and to this end the provisions of this section are hereby declared to be severable.
