113.02 PURCHASING PROCEDURES.
   The City Manager shall promulgate rules and regulations known as purchasing procedures providing for the manner in which each office, agency or department shall order supplies, materials and equipment. The Administrative Assistant of Purchasing shall enforce such rules and regulations, and shall, subject to the approval of the City Manager, recommend amendments thereto. The rules and regulations may provide for the preparation of specifications, notice to bidders, public notice and public opening of bids and for such bond as may be deemed necessary from time to time. Competitive acquisition shall be required for all purchases in excess of the amount which may be from time to time established by the provisions of West Virginia Code §5A-3-11. The competitive acquisition process or requirement established herein shall not be applicable to an emergency, as hereinafter defined, or to the utilization of grant funds obtained by the City from any governmental agency, department, division or entity for or on behalf of a nonprofit-nonstock organization, corporation or entity, unless otherwise required by law. An emergency exists only when the protection and preservation of public property is necessary, or to preserve the health and safety of persons. Only the City Manager may authorize emergency purchases by setting forth, in writing, the facts constituting the emergency, and that to the best of his knowledge the account to be charged has a sufficient unencumbered balance for the amount of the purchase. Such statement shall become a part of the purchasing record.
