Nothing herein contained shall be construed to provide indemnification of any elected official, officer, agent or employee of the City for any conversion or diversion of public funds, act or omission in bad faith, or criminal act, for which such elected official, officer, agent or employee would be liable under the laws of the State to a third party or the City.
