(a) There is hereby imposed upon every person who is found guilty or who pleads guilty or nolo contendere for a violation of any ordinance of the City of Fairmont, a mandatory court cost of ten dollars ($10.00) to defray the costs of operation and administration of the tax refund offset program authorized by West Virginia Code 8-10-2(b).
(b) Said mandatory court cost shall be assessed as a part of the costs of the Municipal Court proceedings and shall be in addition to all other court costs and fees as may be allowed or provided by law and shall be collected by the Clerk of the Municipal Court.
