All offices and positions of the City are hereby allocated to the personnel system as "classified service" or "exempt service". The exempt service shall include:
(a) All elected officials and members of citizen boards, committees and commissions;
(b) City Manager;
(c) City Attorney;
(d) City Judge;
(e) All other personnel appointed to serve without compensation.
The classified service shall include all other full-time positions of the City service which are not specifically placed in the exempt service by the personnel rules and regulations. These rules shall cover all employees in the classified service.
Although the employees in the exempt service are not conditionally subject to these rules, they shall be considered regular employees and shall be covered by all except where, by virtue of their content, they would logically be construed as concerning only the classified service.
Pursuant to Section 3.04
(6) of the City Charter, the rules may, from time to time, be amended only by proposal of the City Manager, and may be adopted by ordinance.
Any officer, employee or citizen who feels that the rules are working or are apt to work any unnecessary hardship on him, or that the efficiency of the City service can be improved by amendment to the rules and regulations, may consult with the City Manager and be granted a hearing. Employees of the City, however, shall be governed in their actions by the grievance procedures hereinafter established.
Any employee holding a position at the time this section takes effect, or when the Charter took effect, who was serving in the same or comparable position after the adoption hereof, shall not be subject to competitive tests as a condition of continuance in the same position provided, however, that supervisory personnel at pay grade fifteen and above, at the discretion of the City Manager, may be required to take and complete satisfactorily qualifying examinations.
