In the event any person shall produce, create, generate or bring into existence within the City or transport to the City, any solid waste contaminated with petroleum, petroleum products or by-products of petroleum or any fraction thereof, the character, nature, form or composition of which, when treated, untreated, recycled or unrecycled would not be permitted to be disposed of in a state approved sanitary landfill, as prohibited by Section 1111.02, in violation of the provisions of this article, the City Attorney is authorized, upon instructions from the City Manager, in addition to other penalties set forth herein, to institute any appropriate civil action or proceedings to prevent the production, creation, generation or bringing into existence within the City or the transporting to the City, any solid waste contaminated with petroleum, petroleum products or by-products of petroleum or any fraction thereof, the same being deemed a public nuisance.
