All fees and charges for the stormwater works and/or the stormwater management system, if not paid when due, shall constitute a lien upon the lot, parcel of real estate, building or structure to which said fees and charges apply. If any service fee or charge so established is not paid within twenty days after the same is due, the amount thereof, together with the penalty provided by Section 945.05, and a reasonable attorneys fee, may be recovered by the Stormwater Utility in a civil action in the name of the City of Fairmont, and in connection with such action said lien may be foreclosed against the lot, parcel of land or building, in accordance with the laws relating thereto.
