941.26 APPEAL.
   Any person, firm, corporation or organization who may be aggrieved by any decision, order, notice or directive of the Director may appeal the same in writing to the Sanitary Board for the City of Fairmont by the filing of a written petition for appeal with the Sanitary Board within ten (10) days of receipt of the final decision, order, notice or directive. The time within which the appeal shall be filed is jurisdictional. The petition for appeal shall set forth all relevant facts and the particular requirements or issues being appealed. A copy of the order, notice, decision or directive shall accompany the petition for appeal. The Director shall develop a form petition for purposes of appeal. Except in situations which constitute an imminent threat to the public health, safety, welfare and environment of the Greater Fairmont watershed, as determined by the Director, if an appeal is timely perfected, the order, notice, decision or directive appealed from may be stayed by the Board pending appeal. The Sanitary Board shall hear the appeal at the earliest practical date and may affirm, reverse or modify the order, decision, notice or directive. The Sanitary Board shall make findings of facts and conclusions which support the decision to affirm, reverse or modify the order appealed from. The decision of the Sanitary Board shall be final subject, however, to review by a Court of competent jurisdiction.
