937.07 PRESUMPTION OF BENEFIT OF SANITATION SERVICE.
   The existence of any residential structure, including any single family residence, multiple family residence, or housing unit, any church, synagogue, or temple, or other non- business non-residential structure without alternative solid waste disposal services, [or any business or institutional enterprise occupying or in operation] shall be prima facie evidence that solid waste is being produced and accumulated on the premises, and that a benefit is being derived from the administration and enforcement of this article and that the owners of such property are responsible for the payment of the solid waste collection and disposal fee. Provided that the prima-facie evidence may be rebutted by presenting in advance to the City Manager or his representative proper proof by the property owner that the structure will be vacant for a period of not less than three consecutive months, provided that accrued payments will not be affected; and provided further that proof of non-occupation must be provided in advance of the non-occupation period.
