(a) If any owner, tenant, occupant and/or other person or persons responsible shall fail to comply with any notice issued hereunder, after a hearing thereon, the Municipal Judge may, in his discretion, direct that the City of Fairmont shall cause the violation to be abated either through an available City department or by contract or arrangement with private persons, and the cost of such abatement shall be charged to such owner, tenant, occupant and/or other person or persons responsible.
(b) Additionally, whoever violates any provision of this code shall, upon conviction thereof, be guilty of a misdemeanor and shall be subject to a fine of not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00).
