913.05 GENERAL BENEFIT.
   Notwithstanding any of the foregoing provisions, local assessment, pursuant to West Virginia Code 8-18-1 et seq, for improvement shall be local in character as distinguished from general. If the improvement should be general in its nature, in that it confers a general benefit and advantage on the property of the whole community to the same extent substantially as on the property abutting upon or in close proximity to the improvement, or on property in the area to be assessed, it shall be regarded as a general, as distinguished from a local improvement, and such improvement shall not be subject to local assessment.
