905.01 OBSTRUCTIONS; PERMISSION REQUIRED.
   (a)   Obstruction, Generally. No person shall without first having obtained permission, as provided in subsection (c) hereof, fence, or obstruct or cause to be fenced or obstructed any street, avenue, road, way, alley, sidewalk, crossing, gutter, or drain within the City.
   (b)   Obstruction, Specific. No person shall without first having obtained permission, as provided in subsection (c) hereof, place a dumpster or cause a dumpster to be placed on any street, avenue, road, way, alley, sidewalk, crossing, gutter or drain within the City.
   (c)   Procedures.
      (1)   Any person who desires to temporarily place a dumpster on or otherwise obstruct any street, avenue, road, way, alley, sidewalk, crossing, gutter, or drain in any way whatsoever must make written application to the Director of Public Works seeking permission to place said dumpster on or otherwise obstruct any street, avenue, road, way, alley, sidewalk, crossing, gutter, or drain whatsoever.
      (2)   The application shall be in the form and the manner prescribed by the Director of Public Works and shall be presented to the City of Fairmont Planning Department at least ten working days prior to the intended or proposed date of placement.
      (3)   The applicant shall pay a filing fee of ten dollars ($10.00) at the time the application is submitted to the City of Fairmont Planning Department.
      (4)   The Director of Public Works may authorize the issuance of a permit temporarily allowing the placement of a dumpster or any other obstruction on any street, avenue, road, way, alley, sidewalk, crossing, gutter, or drain within the City in accordance with the following requirements/restrictions:
         A.   That no dumpster or obstruction shall be permitted on a street less than twenty (20) feet in width;
         B.   That the dumpster must be equipped with Type II Reflective Equipment; and
         C.   That Type II Reflective Equipment must be placed at each end of the dumpster.
      (5)   The initial permit for a dumpster or other obstruction shall not be issued for a period of longer than fifteen days. However, the permittee can make a written request for an extension or renewal of such permit and said request shall be made at least forty-eight hours of the expiration date of the initial permit.
   (d)   If any person permits or causes a dumpster or other obstruction to continue to exist on any street, avenue, road, way, alley, sidewalk, crossing, gutter, or drain within the City after a permit issued under this section has expired, it shall have the same effect as though no permit had been issued.
