760.02 DEFINITIONS.
   (a)   “Local Enterprise Zone” means a geographical region within the corporate limits of the City that satisfies the United States Department of Housing and Urban Development’s statutory eligibility criteria/requirements for designation as an Urban Federal Empowerment Zone and designated by ordinance.
   (b)   “Taxpayer” means a natural person, firm, limited liability company, partnership, or corporation liable for business and occupation tax under Article 761 of the Fairmont City Code.
   (c)   “Employee(s)” means any person holding less than a 5% ownership interest in the business working for a wage, salary or commission at a site within a local enterprise zone.
   (d)   “Full time” means employed for a wage, salary or commission for at least thirty-five hours per week. In addition full time shall mean any number of employees who together are employed for a wage, salary or commission for a total of at least thirty-five hours per week. For example: two employees each working seventeen and ½ hours per week constitute one full time employee.
   (e)   “Substantial renovation” means renovation, renewal, rehabilitation of an existing structure or structures located within a Local Enterprise Zone, which renovation, renewal, and rehabilitation must be in compliance with all federal, state and local building codes and local zoning regulations and requirements, and which renovation shall include facade and exterior renovations, renewals and rehabilitations which must be pre-approved by the City and which must follow the general design criteria to be established by the City.
   (f)   “New facility” means a building or series of buildings constructed with new construction materials which construction must be in compliance with all federal, state and local building codes and local zoning regulations and requirements, and the plans for which including the style and design of the facade and exterior must be pre-approved by the City and must following the general design criteria to be established by the City.
