(a) The Director of Public Service shall promulgate detailed Wireless Facility Design Guidelines with objective, technically feasible criteria applied in a non-discriminatory manner that reasonably match the aesthetics and character of the immediate area regarding all of the following, which the City shall consider in reviewing a right-of-way permit application that involves a wireless facility, small cell facility, or wireless support structure:
(1) The location of any ground-mounted wireless facilities, small cell facilities or wireless support structures;
(2) The location of a wireless facility, small cell facility or wireless support structure;
(3) The appearance and concealment of wireless facilities, small cell facilities, and wireless support structures, including those relating to materials used for arranging, screening, and landscaping;
(4) The design and appearance of wireless facilities, small cell facilities, and wireless support structures.
(b) The Wireless Facility Design Guidelines shall provide examples of acceptable wireless facilities and small cell facilities including visual depictions.
(c) The Wireless Facility Design Guidelines shall provide administrative and procedural guidance to applicants, such as a list of minimum application requirements.
(d) The Mayor and/or the Director of Public Service shall have the authority to update and supplement the Wireless Facility Design Guidelines to address relevant changes in law, technology, or administrative processes. In the event of any conflict between the Wireless Facility Design Guidelines and the City of Fairlawn Codified Ordinances, the language of the Fairlawn Codified Ordinances shall take precedence over the language of the Wireless Facility Design Guidelines.
