(a) Maintenance and Repair. The Mayor and the Director of Public Service, or his or her designee, in their discretion, shall have the authority to negotiate and enter into any agreements that may be necessary to ensure the proper maintenance and repair of the fiber optic network used to provide broadband services to customers of the FairlawnGig utility, including but not limited to any agreements to provide maintenance and fiber restoration services. The terms and conditions of such agreements shall be determined by the Mayor and the Director of Public Service, or his or her designee, in their sole discretion.
(b) Installation or Leasing of Additional Fiber or Conduit. To the extent that it becomes necessary to construct, install, or lease any additional fiber, conduit, or other equipment in order to provide broadband services to a FairlawnGig customer or customers, the Mayor and the Director of Public Service or his/her designee, in their discretion, shall have the authority to negotiate and to enter into any agreements that may be necessary to provide for the construction and installation of new fiber and conduit, and shall have the authority, in their discretion, to negotiate and to enter into any agreements to lease or use fiber, conduit, or other equipment owned by another political subdivision or any other third party. The terms and conditions of such agreements shall be determined by the Mayor and the Director of Public Service, or his or her designee, in their sole discretion.
(c) Wireless Network. The Mayor and the Director of Public Service, or his or her designee, in their discretion, shall have the authority to negotiate and enter into any agreements that may be necessary to ensure the proper maintenance, repair, and operation of the wireless network, including but not limited to any pole attachment agreements or other agreements relating to the installation, repair or maintenance of wireless support structures and facilities. The terms and conditions of such agreements shall be determined by the Mayor and the Director of Public Service, or his or her designee, in their sole discretion.
