(a) The Mayor and the Director of Public Service or his/her designee, in their discretion, shall have the authority to negotiate and enter into agreements for the use or leasing of the FairlawnGig fiber-optic network by other internet service providers or other wholesale customers. The terms and conditions of such agreements shall be determined by the Mayor and the Director of Public Service or his or her designee in their sole discretion.
(b) The Mayor and the Director of Public Service or his/her designee, in their discretion, shall have the authority to negotiate and enter into agreements for the use and leasing of the data center for the FairlawnGig utility, including any co-location services. The terms and conditions of such agreements shall be determined by the Mayor and the Director of Public Service or his or her designee.
