(a) Inspections. The Fire Prevention Bureau of the Division of Fire and Emergency Rescue Services, hereinafter referred to as the Fire Prevention Bureau, is authorized and directed to make inspections pursuant to the Ohio Building Code, Ohio Fire Code, Codified Ordinances of the City of Fairlawn and requirements imposed by the Fairlawn Planning Commission to determine the conditions of all business units and premises located within the City. Subject to the provisions of the Ohio Building Code, Ohio Fire Code, the Codified Ordinances of the City of Fairlawn and requirements imposed by the Fairlawn Planning Commission, the Fire Prevention Bureau is authorized to enter, inspect and survey at all reasonable times all business units and premises as permitted by the above referenced codes.
(b) Investigation of Complaints of Violations. Pursuant to any citizen complaint the Fire Prevention Bureau shall investigate and inspect any business unit or premises for compliance with all applicable codes. The Fire Prevention Bureau shall make a written record of such investigation and inspection.
(c) Access to Business Units and Premises. The owner, operator or occupant of every business unit or the person in charge thereof, on request of the Fire Prevention Bureau, may give the Fire Prevention Bureau free access to the business unit and its premises at all reasonable times for the purpose of inspection and survey. If entry is refused or not obtained, the Fire Prevention Bureau shall conduct the inspection only as provided by law. This Part shall not be construed to require an owner, operator or occupant to consent to a warrantless inspection of a business unit or premises except as provided by law.
(d) Reporting Other Violations. The Fire Prevention Bureau may also refer any visible violations of the health, building or safety codes of the City of Fairlawn, Summit County, Ohio, and the State of Ohio, witnessed during any inspection executed pursuant to the provisions of this Part to the appropriate administrative agency or officer.
