(a) Prerequisites. The owner or operator of a premises shall have the interior or exterior of the premises, its structures and dwelling units inspected annually, for a minimum of two years, to determine compliance with all applicable codes under the following circumstances:
(1) If two (2) or more notices and orders have been issued to the owner or operator pursuant to Section 1508.02 or Section 1508.04 of this Part, within any two (2) year period, concerning the same premises, and have not been complied with within the time provided in the notices and orders, the premises that was the subject of the notices and orders to comply shall be subject to annual mandatory inspections as specified in this section; and
(2) If the owner or operator has been convicted of a violation of this Part, the premises and structures where the violation occurred shall be subject to annual mandatory inspections as specified in this section.
(b) Outstanding Order. A notice and order that is outstanding thirty (30) days after the effective date of this Part, or that is issued subsequent to the effective date of this Part, may constitute a non- complied notice and order for purposes of enforcement of the annual mandatory inspections required by paragraph (a)(1) of this section.
(c) Prior Convictions. A conviction that was obtained within one (1) year prior to the effective date of this Part, or that was obtained based on a notice and order that was outstanding at the time of the effective date of this Part, or that is otherwise obtained subsequent to the effective date of this Part, shall constitute a conviction for purposes of enforcement of the annual mandatory inspections required by paragraph (a)(2) of this section.
(d) Failure to Obtain Mandatory Inspection. No owner or operator of a dwelling or premises shall fail to obtain a mandatory inspection from the Residential Chief Building Official when the provisions of this section require a mandatory inspection.
(e) Inspection Fee. An inspection fee shall be imposed for each annual mandatory inspection as required by this section as follows, or as may be established by the Real Property Maintenance Board:
(1) For premises with one (1) to four (4) dwelling units, a fee of two hundred fifty dollars ($250.00);
(2) For premises with five (5) to ten (10) dwelling units, a fee of two hundred sixty-five dollars ($265.00);
(3) For premises with eleven (11) or more dwelling units, two hundred eighty dollars ($280.00) for the first eleven (11) rental units and an additional fee of fifteen dollars ($15.00) per unit in the premises.
(f) Use of Funds. Money collected under this section shall be used exclusively for mandatory inspection purposes.
