1520.02   CRIMINAL PENALTIES.
   (a)   Criminal Penalties. Any person, owner, operator, occupant or purchaser who violates or fails to comply with any of the provisions of this Part shall be guilty of a misdemeanor of the third degree and shall be fined not more than five hundred dollars ($500.00) or imprisoned not more than sixty (60) days, or both, and shall, in addition to any other penalties within these maximum amounts, be subject to imposition of the following minimum mandatory penalties, which shall not be suspended or held in abeyance:
      (1)   A person, owner, operator, occupant or purchaser who has not previously been convicted of any violation of a section of the Fire Prevention Code, the Building Code, the Zoning Code or all applicable codes, shall be fined up to fifty dollars ($50.00);
      (2)   A person, owner, operator, occupant or purchaser who has previously been convicted of one (1) violation of a section of the Fire Prevention Code, the Building Code, the Zoning Code or all applicable codes, shall be fined up to two hundred dollars ($200.00);
      (3)   A person, owner, operator, occupant or purchaser who has previously been convicted of two (2) violations of a section of the Fire Prevention Code, the Building Code, the Zoning Code or all applicable codes, shall be imprisoned not less than three (3) days and fined up to three hundred fifty dollars ($350.00); and
      (4)   A person, owner, operator, occupant or purchaser who has previously been convicted of three (3) or more violations of a section of the Fire Prevention Code, the Building Code, the Zoning Code or all applicable codes, shall be imprisoned for not less than ten (10) days and fined not more than five hundred dollars ($500.00).
