406.07   RESERVATION OF POWER TO COUNCIL.
   Council reserves to itself authority concurrent with that of the Director of Public Safety to regulate by ordinance all matters referred to in Section 406.03.

406.08   PROCEDURE.
   When the Director of Public Safety proposes to make and issue any rule or regulation on a subject set out in Section 406.03, he shall promulgate the same in writing and forward the same to the Clerk of Council, who shall present it to Council at its next meeting. Such rule shall take effect the day after the next regular or special meeting of Council succeeding its presentation thereto by the Clerk, unless, prior to such time, Council adopts a resolution of disapproval.

406.09   PUBLICATION.
   Rules and regulations made and issued by the Director of Public Safety pursuant to Section 406.03 shall be published by the Director in the manner provided by Council for publication of its acts. Such publication shall be made within ten days after presentation of the rule or regulation to Council and shall state, inter alia: “This Regulation shall be effective (specify date) unless disapproved by Council prior thereto.”

406.10   VIOLATIONS SUBJECT TO GENERAL CODE PENALTY.
   Any person violating the rules and regulations promulgated in connection with this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof shall be subject to the penalties provided for in Sections 408.01 and 408.02.
406.11   SPEED LIMITS AND INCREASED PENALTIES IN CONSTRUCTION ZONES.
   (a)   The Mayor or Director of Public Safety by written order may establish special speed limits within construction zones that may vary based upon the work being conducted, the safety risks involved, or any other criteria the Mayor or Safety Director may consider appropriate under the circumstances that will reasonably promote the safety of the public. The Mayor or Safety Director may also establish increased penalties for traffic violations in a construction zone, up to double the normal penalty for such violations.
   (b)   If the Mayor or Safety Director establish special speed limits within a construction zone, they shall cause signs to be erected advising motorists of the special speed limits and also of any increased penalties for traffic violations in a construction zone. Increased penalties shall be effective only when such signs are erected consistent with the design specifications established pursuant to Ohio Revised Code and the rules and regulations of the Ohio Department of Transportation, and when a violation occurs during hours of actual work within the construction zone.
