(a) Generally. No person shall violate any of the requirements of this chapter or the OFC Section 1301:7-7-31.
(b) Exhibitors. A licensed exhibitor of fireworks who wishes to conduct a public fireworks exhibition within the City shall apply to the Fire Chief and the Police Chief.
(1) The application shall be on a form which has been approved by the Fire Marshal or if available from the Fire Chief. A copy of the exhibitor's license shall accompany the application.
(2) The approval for the exhibition shall be in writing signed by both the Fire Chief and the Police Chief.
(3) The Fire Chief and Police Chief will conduct an on-site inspection of the detonation and landing areas.
(4) The permit, when issued, shall bear a number and shall be forwarded to the Fire Marshal for filing and tracking.
(5) A permit is not transferable.
(6) The exhibitor shall provide a copy of their insurance coverage, with the City named as added insured, in the amount of not less than two million dollars ($2,000,000) against injury or death or a surety that is satisfactory to the Law Director in the amount of two hundred fifty thousand dollars ($250,000).
(c) Permits.
(1) No exhibition shall be set up or conducted until the required permit has been issued.
(2) The fee for each permit shall be fifty dollars ($50.00) plus the cost of any City employee required to safeguard the operation, and shall be payable to the City of Fairlawn.
