1060.08   COLLECTORS; PERMIT REQUIRED; VEHICLES; INSURANCE.
   (a)   Definitions. As used in this section, unless otherwise provided:
      “Curbside” means close to the traveled portion of the street or roadway, but in such a manner as to avoid interference with the safe and free flow of pedestrian and vehicular traffic.
      “Curbside recycling container” means a storage unit in which recyclable materials are placed.
      “Glass food and beverage container” means any glass bottle or jar used to package food or beverage products.
      “Materials recovery facility” means a facility for the collection, sorting, processing, transfer or sale of recyclable materials for the purpose of reclaiming material.
      “Metal food and beverage can” means any aluminum, bimetal or steel can used to package food or beverage products.
      “Newspaper” means used or discarded newsprint, including inserts.
      “Plastic container” means only PET/HDPE bottles or jugs.
      “Recyclable material” means and includes newspaper, magazines, metal food and beverage cans, glass food and beverage containers and PET/HDPE plastic bottles and jugs.
      “Recycling vehicle” means a truck used solely for the purpose of collecting and transporting recyclables, which vehicle must be clearly marked with the word “recycling” and/or display the recycling three - arrow symbol.
   (b)   Collection and Removal; Permit Required.
      (1)   No person shall engage in the business of collecting or removing recyclables, garbage, animal or vegetable refuse, ashes, rubbish, trash or waste materials of any kind (residential or commercial) within the City and upon its streets without obtaining a permit to do so and complying with the requirements of this section.
      (2)   Each permit holder providing residential solid waste collection must provide a weekly curbside recycling collection service on the same day as the residents' current weekly refuse collection and a drop-off site recycling program to customers in multifamily/ apartment units.
      (3)   Services for the collection of residential Municipal solid waste and recyclables can only occur on weekdays. No permit holder shall collect and/or dispose of garbage and/or rubbish within the City between 7:00 p.m. and 6:00 a.m.
   (c)   Application for Permit; Issuance; Fee.
      (1)   Whoever desires a permit to engage in any business described above shall make written application at the Public Service Department. The written application must be made on the form provided, correctly stating the following information:
         A.   The make, model, year and current registration license number of any motor vehicle used in the business;
         B.   A brief description of the type of materials to be collected;
         C.   The applicant's business name, address and telephone number;
         D.   The name, address and telephone number of each principal owner of the applicant;
         E.   The type of business (commercial or residential);
         F.   The location of the site for disposing of solid waste and recyclables.
      (2)   Upon payment by the applicant of a permit fee of one hundred dollars ($100.00), the Public Service Department shall issue to the applicant a permit, valid from the date of issuance to the same date of the following year, together with a license identification to affix to each motor vehicle. During the period of validity of the permit, the license identification shall be displayed upon each motor vehicle in an unobscured, conspicuous place. The permit fee above described shall be collected for the purpose of reimbursing the City for the cost of processing the permit application.
      (3)   Each permit holder shall be required to post with the City a one thousand dollar ($1,000.00) cash or surety bond to insure the faithful performance of duties and responsibilities required of him or her under this section and other ordinances regulating vehicular traffic in the City, as well as trash and recyclable collection and transportation. The cost for the City to clean streets where spills occur may be deducted from the surety provided.
      (4)   Each permit holder shall conspicuously place or cause to be placed on each refuse truck operated in the City the company name and telephone number, as stated on the permit, in letter size of not less than six (6) inches in height.
   (d)   Insurance. A certificate of insurance in the amount of two million dollars ($2,000,000) combined single limit (combined bodily injury and property damage) per accident is hereby required of each permit holder.
   (e)   Prevention of Spillage From Vehicles. No permit shall be issued for any motor vehicle which is not equipped with an adequate covering, such as a tarpaulin or other suitable material, such covering to effectively prevent materials collected therein from blowing from or falling off the motor vehicle. No permit shall be issued for any motor vehicle whose bed, body or containers thereon are not properly constructed so as to prevent the dropping or leaking of the materials collected therein or thereon.
   (f)   Noncompliance; Impounding; Permit Revocation. Any motor vehicle licensed in accordance with the above and subsequently found by the Police Division not to be in compliance with the requirements of the above may be impounded. In such case, the permit holder shall be ordered to comply with such requirements. Upon the permit holder's failure to do so, the Public Service Department, upon the recommendation of the Police Division, may revoke the permit holder's permit.
   (g)   Required Collection of Recyclables.
      (1)   Each permit holder providing residential solid waste collection services will be required to submit to the Public Service Department, for approval, a brief description of the type of recycling program that will be offered to both single-family and multifamily/apartment units and commercially zoned properties.
      (2)   Each permit holder must provide, for curbside recycling program participants, a weekly curbside recycling collection service. This service must be provided on the same day as the residents' regular refuse is collected. In addition, a drop-off site program must be provided for customers in multifamily/apartment units. The recyclable materials must be collected with a recycling vehicle.
      (3)   The permit holder will provide each curbside recycling program participant with a curbside recycling bin and instructions on how to participate in the recycling program. A recycling bag/bin system must also be implemented for multifamily/apartment units.
      (4)   Recyclable materials shall include, at a minimum, magazines, newspaper, metal food and beverage cans, glass food and beverage containers, and plastic bottles or jugs types PET/HDPE.
      (5)   The collected recyclable materials must be transported by the permit holder to an approved materials recycling facility. Receipts must be obtained from the materials recycling facility as to the amount of material that has been delivered. No permit holder shall dispose of recyclable material other than through an approved materials recovery facility.
   (h)   Reporting Mechanisms.
      (1)   Each permit holder must complete a semi-annual Municipal solid waste form by July 15 of every year and January 15 of the following year and file it with the Public Service Department.
