(a) Any property owner in the City authorized by the Utilities Commissioner to connect to a sanitary sewerage system shall pay the applicable overuse charge if:
(1) The property connects directly or indirectly to a sewer, pump station or sewage disposal system for which the property was not assessed; or
(2) The property connects directly or indirectly to a sewer, pump station or sewage disposal system and lies outside of the geographical area which the public or private improvements were originally intended to serve.

(b) The overuse fee applicable to the City sanitary sewerage system is $2,110 per benefit, as determined by the City Engineer.
(c) All overuse fees shall be paid in full prior to the execution of the residential subdivision plat by the appropriate City officials or prior to the execution of the final building plan approval for multifamily, commercial and/or institutional development by the appropriate City officials.
