Any written fence agreement by the parties shall be submitted to the City Building and Zoning Office. It is not a prerequisite to obtaining a permit that a written fence agreement of the parties be made. However in the event that there is a written fence agreement, the parties must submit the same to the City Building and Zoning Officer before a permit is issued. It shall be the responsibility of the parties to a fence agreement, not the City of Fairfield, to record any written fence agreement with the Wayne County Clerk & Recorder's Office, to ensure that the provisions concerning the written fence agreement permanently run with the land.
