§ 150.37 PERMIT REQUIRED.
   (A)   A fence may not be constructed within the city limits without first having obtained a permit from the city. The application fee for a permit to construct a fence shall be $50.Anyone desiring to construct a fence within the city shall make an application, and pay the application fee, to the City Building and Zoning Officer. Once issued, the permit shall run with the land and remain valid until the property changes use or the use is abandoned and non-operational for a period of 12 consecutive months.
   (B)   The application for a fence permit shall include but not be limited to, the following requirements:
      (1)   Shall contain a statement that the applicant affirms that they are the owner of the property, or (in cases of joint ownership) shall contain a statement that the applicant is a co-owner or joint owner of the property and has the consent of the other co-owner or joint owner to construct a fence on the proposed property.
      (2)   Shall attest that no part of the fence will encroach upon any portion of the adjoining property and is completely located upon the applicant's property, unless a permit is sought to build a division fence, in which case the application will be signed by both property owners.
      (3)   In cases of a division fence, shall provide detailed drawings of the proposed fence including property lines and distance from property lines.
