§ 9.12.030 VIOLATION; PENALTY.
   (A)   A violation of the provisions of this chapter is declared to be a public offense. Any person violating the provisions of this section shall be deemed guilty of an infraction and, upon conviction thereof, shall be punished by a fine not exceeding $500, except as provided in division (B) below.
   (B)   If any person is arrested or cited for a second or subsequent offense under this section within one year of a prior conviction, then the person violating the provisions of this section shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine not exceeding $500 or by imprisonment not exceeding six months, or by both the fine and imprisonment.
