The Town Manager may exempt a retail food vendor or restaurant from the requirements of the provisions of this chapter for a one-year period; and subsequent exemptions may be granted by action of the Town Council, upon a showing by the applicant that the conditions of this chapter would cause undue hardship. The phrase "undue hardship" may be construed to include, but not be limited to:
(A) Situations where there are no acceptable alternatives to polystyrene foam food packaging for reasons which are unique to the retail food establishment.
(B) Situations where compliance with the requirements of this chapter would deprive a person of a legally protected right.
