(a) An application shall be granted or denied within 30 days from the date of the Village's receipt of a completed application except as provided under division (d) of this section.
(b) The permit shall state on its face the name of the person or persons to whom it is granted, the address of the teen dance event business, and the permit expiration date. The permit shall be posted at all times in a conspicuous place at or near the entrance to the teen dance event.
(c) An application may be denied for any of the following reasons:
(1) An applicant's permit to operate any teen dance event business has been denied or revoked within the preceding 60 months.
(2) The premises to be used for the teen dance event are not in compliance with Village or county health, fire, zoning and/or building codes as determined by the governmental agency responsible for determining such compliance.
(3) An applicant has failed to provide information as requested in the application or has supplied false information.
(4) The application fee has not been paid.
(5) To grant the application would violate a statute, resolution, or court order.
(6) Any owner, operator or permittee fails to pass the criminal background check as set forth in Section 881.03.
(7) The business for which a permit is sought, or for which renewal of a permit is sought, has been declared a nuisance as defined under the Ohio Revised Code or under the terms of any ordinance passed under the Home Rule Powers of the Village.
(8) If, after an investigation is conducted by the police, that the issuance of the permit will disturb the peace and quiet of the surrounding neighborhood, or the ability of neighboring businesses to conduct their business in a normal and customary manner.
(d) As set forth in Section 881.03, all Village departments responsible for the enforcement of health, fire, building and zoning codes and laws shall determine if the proposed business is in compliance with its area of regulation within 20 days of receipt of a completed application. If the applicant requests additional time to comply with a statute, code, ordinance, regulation or other law in effect in the Village, a one-time extension of an additional 30 days may be given for the Village to grant or deny the application provided that a permit must be approved or denied no later than 30 days before the proposed event. The Mayor or his designee and the Village Police Officers and Fire Department personnel shall at all times have access to any premises for which a permit for a teen dance event has been issued.
