1040.15  NOTICE TO REMOVE DRAINAGE OBSTRUCTIONS.
   Whenever the Mayor finds that, by reason of the making of a fill or partial fill thereon, a tract of land is inadequately drained, or that such fill obstructs or interferes with lawfully existing sewerage or drainage, he shall notify the owner of such tract to remove the fill or to provide the necessary sewerage or drainage to eliminate the obstruction. Such notice may be served upon the owner by personal delivery, by mail at his last known place of residence or by posting on the premises. Failure, after such notice, to remove the fill or to provide the necessary sewerage or drainage shall constitute an unlawful act, if continued for a period of ten days.  A separate offense shall be deemed committed each ten day period during which the owner fails to carry out the order of the Mayor.
