610.08  SOLID MATTER IN COMBUSTION GASES.
   (a)   (1)   Solid particles in combustion gases from any fuel-burning equipment in excess of .5 pound per 1,000 pounds of gases, adjusted to twelve percent CO2 allowed to escape into the air or allowed to pass any convenient measuring point in the chimney or breeching system is hereby declared to be an air pollution nuisance and shall be unlawful. In no case shall equipment installed for removing solid particles from combustion gases produce a total separating efficiency of less than eighty-five percent by weight.
      (2)   An example of "adjusted to twelve percent CO2 "is as follows: if solid matter in combustion gases at test conditions is .4 pound per 1,000 pounds of gases and test shows ten percent CO2 in the gases, then the solid particles adjusted to twelve percent CO2 would be calculated as follows:
.40 x 12 or .48 pounds per 1,000 pounds of gas adjusted to 12% CO2

   (b)   Whoever violates this section is guilty of a misdemeanor of the fourth degree. Punishment shall be as provided in Section 698.02.
