(a) Air pollution emitted or allowed to escape in such place or manner as to cause injury or detriment to the public or to any person or to endanger the health or safety of such a person or the public, or emitted in such a manner as to cause injury or damage to business or property, is hereby declared an air pollution nuisance, and the emission or escape thereof from any stack, chimney, window, door or other opening, ventilating device or from any building, premises or other source, shall be unlawful.

(b) Whoever violates this section is guilty of a misdemeanor of the fourth degree. Punishment shall be as provided in Section 698.02.
