§ 50.01 UTILITY SERVICE; APPLICATION REQUIRED.
   (A)   (1)   Any person desiring any utility service furnished by the town shall make application to the Finance Office by and through the following. All criteria must be met prior to any utility services being connected and/or reconnected:
         (a)   Completing a “Town of Ethan Utility Account Application” form as approved by the Board of Trustees. Application information shall include, but is not limited to, the applicant’s name, mailing address, service address, phone number, and/or email address;
         (b)   Pay a customer deposit as established by motion;
         (c)   Pay a reconnect fee as established by motion when applicable; and
         (d)   A separate application shall be made for each premise is to be served with town utilities.
      (2)   Applicants shall abide by the rules and regulations established by the town relative to utility service in effect at the time of application and as they may be revised from time to time, in addition to conditions and agreements as the Board of Trustees shall deem advisable.
   (B)   (1)   A landlord is subject to the application process for each rental property as set forth in division (A) above.
      (2)   A landlord who elects to pass the responsibility for payment of utility service onto the renter/tenant(s) and they meet the requirements set forth in division (A) above, will negate the landlord from placing a customer deposit with the application. Said exemption for the customer deposit is only applicable when the landlord has made written acknowledgement of their responsibilities for the property in accordance with § 50.09 of this chapter.
      (3)   Said landlord shall abide by the rules and regulations as established by the town relative to utility service in effect at the time of application and as they may be revised from time to time.
